5 establishments fail state health inspection

The state’s Department of Agriculture conducts yearly inspections of food-serving establishments to ensure public safety and safe food-handling practices. Schools are inspected twice per year, according to the Bureau of Food Safety and Laboratories.

Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should automatically think about establishments non-compliant. Called “critical violations,” they include food temperature issues, issues with chemicals and how they are handled, and employee hygiene.

Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.

Below is a list of establishments listed as compliant and out-of-compliance for inspections conducted Jan. 16-24.

Fraternal Order of Eagles, 105 Park St., Hanover.

Action: Issued 12 violations, including a container of cleaner stored above or on the same shelf with food, equipment, and/or single-use articles, food handler not wearing a hair restraint, severely dented, swollen, distressed canned item, a food employee touching a ready-to-eat food with bare hands, raw beef and fish stored over ready-to-eat foods, food stored directly on the floor in the walk-in freezer rather than 6 inches off of the floor as required, food not reheated to 165°F within two hours, breading had clumps and was not sifted every four hours to remove the clumps, bar ice machine deflector plate and underside of shelf over steam table were not clean to sight and touch, boxes of to-go containers stored on the floor, and outside dumpster lid not closed.

Comment: Manager Scott Hafer stated all of the items listed were corrected within an hour of the inspection. He stated he plans to enroll staff in a food safety course through the Department of Agriculture to avoid future violations.

Lee’s Diner Inc., 4320 W. Market St., York. Action: Issued 10 violations, including onions stored directly on the floor in the basement rather than 6 inches off of the floor as required, breading for chicken had clumps and was not sifted every four hours to remove the clumps, potentially dangerous ready-to-eat food prepared in the food facility and held for more than 48 hours was not being date-marked, dish machine thermometer broken, grill is not positioned under hood in kitchen, no chlorine concentration in the wiping cloth, to-go containers stored food-side-up, using rodent bait placed in bait stations which are not covered and tamper resistant, and soap not available at the hand sink in the kitchen area.

Comment: Owner Omar Ilayan stated the violations have been corrected and he is confident the diner will pass a follow-up inspection. He stated only a couple containers were stored incorrectly. He stated he is not sure why the sink had no soap, but all other sinks had soap.

The delivery man threw the onions on the floor and employees had not yet had a chance to elevate them, he said.

The rodent bait should have been set up correctly because a rodent control company installed it, he said.

Food that was not date-marked was less than a day old, not 48 hours, he said.

Park Hills Elementary School, 137 W. Granger St., Hanover.

Action: Issued four violations, including water-line leak on a pipe on top of the dish machine, water not reaching the proper temperatures for sanitation, paper sticker residue on outer portions of food containers, dust on fan guards in walk-in cooler and food residue on top of dish machine.

Comment: Shawn Harlacher, director of food and nutrition services for South Western School District, stated most of the violations were corrected the same day. He stated a dishwasher was malfunctioning and was not rinsing at a high-enough temperature, so broken heating element has been replaced.

The school used disposable dishes and utensils until the problem was corrected, he said.

Sal’s Pizza, 437 S. Main St., Shrewsbury.

Action: Issued four violations, including meatballs held at 90 degrees, below the required temperature, no hot water at hand sink, old food residue in hand sink, and cold water faucet missing from three-bay sink.

Comment: Owner Carlos Bastida stated he passed a follow-up inspection after fixing the sink, retraining employees on proper food temperatures, and correcting the other violations.

Two Brothers Bar and Grill, 1570 Robin Hood Drive, Newberry Township.

Action: Issued 16 violations, including food in refrigeration units stored open with no covering, raw chicken stored beside lettuce, wet wiping cloths not being store in sanitizer solution, dough mixer bowl with rusty areas on the food contact surface, slicing board was burned and not easily cleaned, rusty shelving in bain marie, loose rubber door gaskets on walk-in cooler, accumulation of dust, dirt, food residue, debris on non-food contact surfaces, accumulation of old food reside inside the microwave oven, inadequate sanitizer strength, clean dish racks stored on the floor in the wash area, hand sinks in restrooms do not grant 15 seconds of continuos flowing water, hand sink with accumulation of residue on the handles and sink area, back door has a gap and does not protect against the entry of insects, rodents, and other animals, ceiling tiles missing or damaged in the kitchen area, and unused equipment and dishes with an accumulation of old food residue, stored in the kitchen area and should be removed from the facility.

Comment: An owner did not return calls for comment.
